General Terms of rental agreement

Once a reservation is confirmed by both Villa Del Mar, Owner or agents, you will receive a Vacation Rental Confirmation (VRC). The VRC becomes a binding agreement once executed. The VRC terms and conditions concerning this villa rental between you (the “Guest”) and Villa Del Mar Owners are agreed upon on this page. Execution of rental agreement and payment in response to VRC constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as written below. If you have any problems or questions with any of the following please reach out to us before execution of VRC.

Half of your rent is due upon receipt of VRC to confirm your reservation and hold your dates. Failure to make this payment within 48 hours subjects your reservation to automatic cancellation. The balance due of rent, fees and taxes must be paid in full at least 60 days prior to your arrival. Failure to pay for balance due will result in the cancellation of your rental agreement. Any monies not received will be subject to cancellation policy, and deposit will be forfeited.

Villa Del Mar is subject to a USVI Occupancy Tax of 12.5%. This tax is subject to change at any time.

A one Thousand dollar ($1,000) fully refundable damage deposit is required. The Deposit maybe required as cash or a hold placed on credit card. If held, the damage deposit is refundable within seven days of your departure, provided there is no breakage, damage, missing items, no additional cleaning for villa left abnormally dirty, and no other charges incurred before, during or after your stay which are still outstanding. You agree to pay Villa Del Mar Owners the cleaning or replacement costs for all damages to property or to the real estate, which may occur as a result of your occupancy. Missing towels, unusually stained linens and towels including staining from self tanning products and make-up are subject to damage deposit. Make-up towels are provided. Normal wear and tear are excluded.

4:00 PM is the earliest allowed check-in time. Check-out time is 11:00 AM or earlier. Exceptions for early check-ins or late check-outs may be possible, depending on if your villa is rented before or after your term of stay. If you arrive earlier and if the schedule allows, your greeter may take you to the villa to drop your luggage, but you must leave and return no earlier than 4pm unless previously arranged. Late check out will result in a $50 per 15 min charge rounded up, with charges starting 15 minutes past the 11a.m. check out time unless previously agreed to in writing.

Guest and their party agree to take all steps required to ensure your family and/or guest are aware and follow all rules and restrictions as set fourth in the agreement. Villa Del Mar is fully furnished, including linens and towels for bath and pool. Guests agree they will not remove items from the villa or rearrange any furniture. Locked pantries and closets are reserved for owners use. Guest agrees they will not tamper or enter locked portions of the villa at any time.

Villa Del Mar is privately owned and operated. The Owner, Property Manager and Agents reserve the right to refuse service to anyone at their discretion. The Owner, Property Manager and Agents will not be responsible for an accident, injury or for the loss of monies, jewelry or valuables of any kind. The property will not be rented to anyone under 25 years of age unless part of guests party. Villa Del Mar, its owners or agents are NOT responsible for guest’s personal belongs that are lost, stolen or left behind.

No smoking of cigarettes, e-cigarettes, or any other device is allowed at any time inside or outside of Villa Del Mar. Smoking at Villa Del Mar will result in full forfeiture of damage deposit.

Small dogs (under 25 lbs) may be allowed with an additional fee and must be approved before rental agreement start. Any pets found on the property that are not approved of prior to arrival can be removed by owners and agents and placed in boarding at Guest expense. Unauthorized pets found on property will result in forfeiture of damage deposit in full, plus any fees incurred by damages from pet.

The total number of persons allowed to stay in the villa at any one time is restricted to the number of persons scheduled and paid for, based on two persons per bedroom, two persons on pull out couch in apartment, with a maximum of twelve (12) adults/children over the age of two (2). Children under the age of two (2) are not included in the final headcount. The villa does not provide bedding for children under two (2). The living room space/couches are not to be utilized as a sleeping space/bed.

The Villa does have security cameras in place outdoors only. The security cameras are for security of the property, and cannot be tampered with or disconnected during usage.

Violation of any of the rules in this agreement may result in Guest and their family/party being asked to leave/removed from the property and rental term cancelled. All monies and deposits are forfeited if removal of party is required.

Property Rules and Restrictions

Guest is responsible for the villa during occupancy and must lock villa’s windows and doors securely at all times when not on the premises. Please secure all personal property.

Villa Del Mar boasts a large infinity edge pool for the guest enjoyment. Usage of the pool and groups are subject to the following-

The Guest understands the following rules and guidelines regarding the pool and terrace. Certain Risks are associated with the use of pool and facilities. The Guest and their family/party understand these risks and agree to hold harmless Villa Del Mar, Its owners and agents. The use of the pool and terraces are at your own risk.

  • There is no lifeguard on duty, all swimming is at risk of guest and their family/party.

  • Children shall not swim in the pool unattended.

  • No Diving into the pool is allowed.

  • There is a risk of injury or death by malfunctioning equipment.

  • There is a risk of injury or death by tripping or falling over objects in or around the pool.

  • The Infinity edge of pool is never to be stood or walked on. Failure to comply with this rule can result in injury or death.

  • The terraces may or not be enclosed with railings. The railings are not to be sat, climbed or stood on. Failure to adhere to this rule could result in injury or death.

Villa Del Mar, its owners and/or agents, assume no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may occur either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa.

By renting the property and executing the VRC, Guest agrees to Hold harmless Villa Del Mar, its owners and agents from any loss, damage, injury, death, expense, or other cost that Guest may suffer or that any individual may suffer in connection with Guest use of the entire Villa property to any cause whatsoever. Guest agrees that he is responsible for any loss by anyone he allows on the property and usage to the property while in Guest possession.

Liability and facility/pool usage

We hope your stay at Villa Del Mar is as carefree as the view from the Terrace, however there are some services over which we do not control.

Interruption of electrical service is common on the island. A back up generator is provided and will typically run during the duration of a power outage, however any unusually long outages may result in the generator running out of fuel. The owners will make all reasonable attempts to refill the generator and sustain power, but this is not guaranteed. Flash lights and candles are provided.

Phone connections-both land line and cellular can be intermittent. Sadly, there is nothing Villa Del Mar can do to accommodate this. Please grab a drink and enjoy the view from any terrace.

Satellite television is managed by other service providers and we cannot promise that the service will not be interrupted or available. We will make every effort to work with the various service providers to restore any interrupted service as quickly as possible but we are at the mercy of the scheduling and effort of the other agency.

Villa Del Mar offers high speed internet and Wi-Fi as a convenience to our guests. This is an unreliable service at times. The periodic interruptions and slow down of the services are not the responsibility of Villa Del Mar.

If the villa or any of its systems or amenities require service or repair the guest will agree to make the villa or room available for the service technician and/or Villa Manager to perform any repairs as necessary; however, they will never enter the villa or the grounds around the pool deck without notifying you first.

While Villa Del Mar will make any and all reasonable attempts to restore all Utility services, we are not responsible for outages. Deductions of rental monies for disruption of services will not be approved.

Utilities

The Owner and Guest agree to remain apprised of the recommendations of the Centers for Disease Control (CDC) and agree to follow the CDC’s recommendations and any additional restriction enacted by the Governor of the USVI leading up to and/or during the Guest’s stay at the Property.  Further, if such government recommendations or restrictions warrant, the Guest agrees to take reasonable steps to restrict access to the Property by any person, including but not limited to the Guest’s invitees, who have been diagnosed or in close contact with or cared for someone diagnosed with COVID-19 or flu-like symptoms within 14 days prior to the Guest's arrival at the Property or during the Guest’s rental period. The Owner and the Guest consent to use of the Property understanding the risks associated with COVID-19, and the Guest and the Guest’s invitees agree to waive and forever release the Owner and its on-island agents of any and all liability or claims associated with the use of the Property and risks associated with exposure or potential exposure to the novel coronavirus including but not limited to, developing the coronavirus disease (COVID-19), or the contraction and transmission of the virus to others who may develop the coronavirus disease.

The Cancellation policy will NOT be altered for persons contracting Covid before or during the stay. Trip Insurance is recommended for all reservations. The failure of the guest to purchase Trip insurance will not absolve the guest from the standard cancellation policy.

Corona-virus precautions and release

Limitations of remedies, damages and indemnity

 In the event the Owner is unable to deliver the Property to the Guest for the full rental period under this Agreement because of fire, eminent domain, act of nature, or act of war, or if the property is unavailable because of delay in construction or any other reason beyond the Owner’s reasonable control, the Guest hereby agrees that the Owner’s sole liability as a result of any of these conditions is a pro-rated refund of rent previously tendered by Guest pursuant to the terms of this agreement for the dates that the property is unavailable to be delivered for occupancy.  If a hurricane or national emergency is declared on the Island of St. Thomas, you have the option to cancel or reschedule your booking without penalty.

After occupancy, the Guest shall not be entitled to any refund due to unfavorable weather, mandatory hurricane evacuation or disruption of utility service (including cable and Internet). Guest agrees to be responsible for the cost of any repairs to the property required due to the negligence of or accidental damage by the Guest or their invitees.  Furthermore, the Guest is responsible for their villa during occupancy, and must lock villa's windows and doors securely when not on the premises. Guest agrees to release, indemnify and hold harmless Owner from and against liability for damage or injury to the person or property of the Guest or to any member of their party, their invitees, or to anyone at the Property, whether invited or not invited by Guest, resulting from any cause whatsoever, except only such a damage or personal injury caused by the gross negligence or intentional acts of the Owner.  The Owner assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa. 

Cancellation Policy

97% refund if cancelled within 60 days of arrival. 50% + deposits and cleaning refunded if cancelled within 30 days. No refunds minus Deposit and cleaning fees within 30 days of check in. We recommend trip insurance for any unforeseen circumstances, including illness due to Covid.
